OurStockWorks is proud to announce our "Win An iPod 2008" campaign. From October 1st through the end of the year every time you purchase a stock image, you get a chance to win an iPod 16gb Nano with your choice of available color. Not only that, but referers have a chance to win! Referers will get one chance to win an 8 gb Nano for each referal they make resulting in a purchase.

We believe our approach offers designers the opportunity to just purchase an image they need rather than having to purchase a package. Not only that, but through our Photo Request they can get an image specific to their needs.

How do I enter?

It is automatic. You get one chance for each small image you purchase and THREE chances when purchasing a large image from October 2008 through December 2008.

When is the drawing?

The drawing will be held the by January 10th of 2009.

How will the drawing be done?

A slip of paper for each chance will be put in a bowl with your ID and image purchased. The drawing will be held in front of a notary and verified. Allow 4 - 6 weeks for delivery after claiming and confirmation. Lost or stolen Prizes will not be replaced.

I have refered a purchasing designer. Do I get anything?

Yes! If you refered the winner, you get an 8gb Nano. Be sure and sign up for the affiliate program.

The winner purchased my image. Do I get anything?

Yes! As the contributor, you will receive an 8gb Nano.

Who is eligible?

Every designer who purchases an image between October 1st, 2008 (GMT) through December 31st, 2008 (GMT), every referer who has had a referal register and purchase an image within the contest period and the contributor whose image is the one purchased by the winning designer. Those countries that the United States cannot do business (State Department) are not allowed to participate. Winners must be 18 years of age or older.

Can someone win who lives outside the US?

Of course. Anyone who resides in a country that can legally do business with the United States can participate however, OurStockWorks will only pay for the iPod and regular shipping. Any additional fees, duties, etc. will be the responsibility of the winner and will not be paid by OurStockWorks.

How can I improve my chances of winning with a referal?

Tell your friends and give them the affiliate link. Put affiliate link graphics on your web site. You can also put text links, where acceptable, in blogs, forums, etc. You cannot SPAM. You cannot SPAM. You cannot SPAM. We will terminate your account on the first offense of SPAMMING. Do not send email to lists or groups that you do not have permission to send to. We cannot stress this enough, we WILL terminate your account on the first offense. You may place banners or links within your new sletters, in content of your website, or within other web related content.

Are there sites or places that I cannot promote OurStockWorks?

OurStockWorks reserves the right to revoke anyone's participation in the program if we decide, at our discretion, that you are generating spam, useless referrals or are not representing OurStockWorks in its best interest. OurStockWorks STRICTLY FORBIDS affiliate websites from promoting OurStockWorks if said website is also displaying hate, pornographic, graphically violent, and/or other offensive material as determined by OurStockWorks.

Agreement to official rules.

By participating in the Win An iPod 2008 you agree to be bound by these Rules. Winners may be required to sign and return an affidavit of eligibility, and a liability/publicity release forms. If you object to or do not agree with any of these Rules, then your winnings will be forfeited..

How will winners be notified?

Winners will be notified by email. Disqualification may result from:

1. The failure of a potential winner to respond to notification within ten (10) days after email transmission of notification of winning the Win An iPod 2008,

2. The return of the email transmission as undeliverable after three (3) attempts,

3. The return of any other communication or Prize as undeliverable, or

4. Other non-compliance with the Rules.

Will my name be release?

We will announce the winner by your user ID. We may use the winner's first name and state/country of residence for promotional purposes in any media without further payment or consideration.

What if I do not want to participate?

Anyone desiring to not participate should notify OurStockWorks their desire via the Contact Form before December 31, 2008.

Are there any more conditons?

The following general conditions apply to the Win An iPod 2008:

1. Void Where Prohibited; Disqualification. The Win An iPod 2008 is void where prohibited, taxed, regulated or where registration is required. All federal, state, provincial and local laws and regulations apply. We reserve the right to disqualify the Entry of any Participant suspected of attempting to disrupt the Win An iPod 2008 and may prosecute or seek other legal action against such Participant.

2. Cancellation. We also reserve the right to cancel, suspend or modify the Win An iPod 2008 if fraud, virus or other technical problem or any other factors beyond our reasonable control in any way interferes or corrupts the administration, security or proper administration of the Win An iPod 2008. If we cancel the Win An iPod 2008, we will award the Prizes in accordance with the judging criteria from among the Entries received to the cancellation date. Failure to enforce a remedy shall not constitute a waiver of the future right to enforce the remedy.

3. Prohibition on Automated Entries. Any use of automated or programmed methods of effecting Entries on-line is prohibited.

5. Release. Except where prohibited, Participant releases and holds harmless OurStockWorks and its subsidiaries, affiliates, and their shareholders, directors, officers, employees and agents and the judges (the "Released Parties") from and against any claim or cause of action arising out of participation in the Win An iPod 2008, human or technical errors, or receipt or use of any prize. IN NO EVENT WILL OURSTOCKWORKS, ITS LICENSEES, AND OR ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, OR ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THE GIVEAWAY.

6. Disclaimer of Sponsor Responsibility. Except where prohibited, Participant agrees that the Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by the Participant or printing errors; (b) unauthorized human intervention in any part of the Win An iPod 2008; (c) technical or human error which may occur in the administration of the Win An iPod 2008 or the processing of Entries; or (d) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the Participant's participation in the Win An iPod 2008 or receipt, use or misuse of any prize.

7. Exclusive Forum for Disputes; Choice of Law. Except where prohibited, Participant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with the Win An iPod 2008 or any prize awarded, other than the administration of the Win An iPod 2008 or the determination of winners, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal courts; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Win An iPod 2008, but in no event attorneys' fees; and (c) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of Participant and Sponsor in connection with the Win An iPod 2008, shall be governed solely by, and construed exclusively in accordance with, the laws of the United Kingdom, without giving effect to any choice of law or conflict of law rules (whether of the United Kingdom or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the United Kingdom.
